, which is that if there is something sort of that we don't know that comes out, this is not a nominee who can probably with stand something like that. i think it's important that chuck schumer, tammy baldwin, normally if nominees fail, whether it's for supreme court or cabinet decisions, they fail in terms of confirmation because the sort of old party of the president pulls back. with harriet myers it was the uprising amongst conservatives that really doomed her. it seems to me john cornyn is not going to be for chuck hagel or john mccain. i doubt they're going to be for chuck hagel, but they don't have to be -- they just have to not filibuster chuck hagel, which i don't think they would do barring something new here. i think if we can do a respectable job with defending some of his more controversial past statements in these hearings they will ultimately not deny his second pick. sfoo gun control and the whole gun issue, it's the second anniversary of tucson. we have the hearing, preliminary hearing for james holmes out in aurora, colorado, and awful testimony coming out of that all week

secretary of defense invites conflict because bulllies don't respect weakness. >> reporter: hagel's defenders point to his two purple hearts in vietnam. >> chuck hagel is a tremendous patriot and statesman. served incredibly in vietnam. served this country as a united states senator. he hasn't had a chance to speak for himself. so why all the prejudging i don't know. >> reporter: the senate has only rejected nine cabinet nominees since 1834. the last time that they rejected a nominee from a president was in 1989 with john tower who was also up for secretary of defense, bill. bill: who are the leading contenders now for cia director, jennifer? >> reporter: mike morale, for one, the acting director of. cia is being considered. they are settling on john brennan, the chief counterterrorism advisor to the president. he has been very close to the president the past four years. he is the white house choice to replace david petraeus. brennan will face serious questions about his role in the cia enhanced teartation techniques program, other controversial bush era programs. this is the reas

think markets would be happy to give up that independence. the troubling is i don't hear anybody right now saying that this appointment or this nomination is going to result in the kind of deal the markets really want. >> former omb director, very popular in the white house, and the administration. the white house argument is he ran circles around them in past negotiations. >> well, that's right. i mean, you have a guy here who is in many sense a consequence mat insider who spent almost his entire professional career in washington on the hill and in the white house. now, that's a good thing and a bad thing. it's a good thing because clearly he knows where the bodies are. he knows the budget inside and out. most important, he has a trust of the praez. that means when he does a deal, the deal will stick. he is speaking for the president. there is a negative side, which is as steve was saying, the markets don't know this guy. financial crisis has a habit of exploding without any warning. he may not have the shots that maybe he needs, an assistant that can provide that experience. there's

the person was not aggressively gay and-- >> what does it mean. i don't know. >> megyn: how do you get to aggressively gay? >> i don't know. maybe it's -- i don't know, maybe -- i don't want to speculate. >> megyn: don't go that. >> i don't want to go in that area. >> megyn: what was he trying to say. >> he apologized. he was trying to say this person would be very out gay person, a person who had embraced their homosexual identity, that this was -- that they were really out and gay. and so he was sorry for having said that and this is how it works in washington. especially if you're a democrat or a republican under the aegis of a democratic president. if you're sorry, it's enough. if you come out and say that you're sorry and that you were misinformed, it's okay. but as you point out. this is sort of the robert bird-strom thurmon rule, if you're going to get more from the people, he said or did something wrong, we know his heart is in the right place and it's okay. versus if you're a conservative or a republican you're not going to get that benefit and they'll chase you down. >> megyn

choice since sort of early/mid-december and i don't think that really wavered even in the face of all this criticism that has come out. first, the president obviously believes that he's qualified. he's a decorated war veteran. in the congress, he served on the foreign relations and intelligence committees. he's co-chair of the president's intelligence advisory board. i think the president and chuck hagel formed a bond over their mutual opposition to the war in iraq. as you know, hagel opposed the surge in iraq. i should add, he opposed the surge in afghanistan, which the president himself authored. but there's one other reason that i think the president looked to chuck hagel. and that is that he believes that hagel will not necessarily just accept the advice of the generals and say "that's it." he believes he will not be intimidated by the generals. that he can stand up to the generals. and in the statement, we heard the president say today, he made it very clear that hagel is, as he put it, geared towards the guy at the bottom who is doing the fighting and the dying. and i think that
